Welcome to Elegant Elements By Kelly LLC.
These Terms of Service (“Terms”) govern your use of our website, products, custom design services, consultations, and other services provided by Elegant Elements By Kelly LLC (“Elegant Elements By Kelly,” “we,” “us,” or “our”).
By accessing our website, purchasing from us, scheduling a consultation, submitting a custom jewelry request, providing horsehair or other sentimental materials, or otherwise using our services, you agree to these Terms.
Please read them carefully before using our website or placing an order.
1. ABOUT ELEGANT ELEMENTS BY KELLY LLC
Elegant Elements By Kelly LLC is a New Jersey-based jewelry business specializing in custom horsehair memorial and heirloom jewelry, fine equestrian jewelry, personalized jewelry, and other equestrian-inspired designs.
Our custom pieces may incorporate horsehair supplied by the client, precious metals, diamonds, gemstones, and other materials selected as part of the design process.
2. ELIGIBILITY & USE OF OUR WEBSITE
By using this website or purchasing from us, you represent that you are legally capable of entering into a binding agreement or are using the website with the permission and supervision of a parent or legal guardian where required.
You agree not to use our website, products, photographs, designs, services, or content for any unlawful, fraudulent, abusive, or unauthorized purpose.
3. PRODUCT INFORMATION
We make reasonable efforts to provide accurate descriptions, photographs, measurements, pricing, gemstone information, metal information, and other product details.
Because jewelry is photographed under varying lighting conditions and viewed on different devices and screens, actual colors and appearance may vary.
Natural gemstones, diamonds, horsehair, and handcrafted materials may also contain natural variations.
Such natural variations are part of the individual character of a piece and are not necessarily considered defects.
4. CUSTOM HORSEHAIR & HEIRLOOM JEWELRY
Custom horsehair jewelry is individually created using horsehair supplied by the client or, where specifically arranged, hair supplied by Elegant Elements By Kelly LLC.
Horsehair is a natural material. Color, thickness, texture, density, length, and appearance will vary.
The client understands that the appearance of horsehair may also change when incorporated into jewelry or when resin, sealants, adhesives, or other finishing materials are used.
By sending horsehair to Elegant Elements By Kelly LLC, the client authorizes us to handle, separate, trim, cut, arrange, set, seal, and otherwise work with the hair as reasonably necessary to create the commissioned piece.
Because horsehair can be deeply sentimental and irreplaceable, we strongly recommend that clients never send us all of the horsehair they possess.
Clients should retain a portion of their horse's hair in a safe location whenever possible.
5. CUSTOM DESIGN PROCESS
Custom jewelry may involve one or more consultations and may include sketches, photographs, CAD renderings, wax models, gemstone selections, metal selections, or other design representations.
The client is responsible for carefully reviewing all design details before giving final approval.
Once the client approves a CAD rendering, wax model, design, or other final design representation and production begins, changes may not be possible.
Changes requested after approval may result in additional design, CAD, labor, material, casting, gemstone, or production charges.
6. CUSTOM DESIGN DEPOSITS
Custom jewelry projects generally require a 50% non-refundable deposit before production begins.
Certain projects may also require a separate non-refundable design or CAD deposit.
Deposits compensate Elegant Elements By Kelly LLC for design time, consultation, sourcing, administrative work, CAD development, materials, and production commitments associated with a custom project.
The remaining balance must be paid in full before the completed jewelry is shipped or released to the client.
Unless otherwise required by applicable law, deposits for custom work are non-refundable once accepted and work has begun.
7. PRICING & PRECIOUS METALS
Prices displayed on our website or provided during a consultation may vary depending upon design, materials, diamonds, gemstones, labor, availability, and current precious-metal markets.
Gold, platinum, diamonds, gemstones, and other materials may experience significant market-price fluctuations.
Custom quotes are therefore valid only for the period specified in the individual quote or proposal.
If no expiration period is stated, Elegant Elements By Kelly LLC reserves the right to confirm current material pricing before accepting a deposit or beginning production.
An estimate or discussion of possible pricing does not guarantee a final price until the project and price have been confirmed by Elegant Elements By Kelly LLC.
8. PAYMENT
Payment must be made using a payment method accepted by Elegant Elements By Kelly LLC.
Depending upon availability, accepted payment methods may include major credit cards, approved electronic payments, checks, or installment-payment services offered through third-party providers.
Orders paid by check will not enter production or ship until payment has cleared.
Third-party payment or installment services are governed by the separate terms and eligibility requirements of those providers.
9. CUSTOM & SPECIAL ORDERS ARE FINAL SALE
Because custom jewelry is created specifically for an individual client, all custom, personalized, engraved, resized, altered, commissioned, horsehair, memorial, and special-order jewelry is FINAL SALE and is not eligible for return, refund, or exchange, except where required by applicable law or expressly agreed to in writing by Elegant Elements By Kelly LLC.
Items clearly identified as Final Sale are also not eligible for return or exchange except where required by law.
Eligible non-custom merchandise is governed by our separate Return & Refund Policy.
10. ORDER CANCELLATIONS
Standard merchandise orders may be canceled only if cancellation is requested and accepted before the order has entered processing or shipment.
Custom orders cannot generally be canceled once the design process, material sourcing, CAD work, fabrication, casting, stone setting, horsehair work, or other production has begun.
Any cancellation rights required by applicable law remain unaffected.
11. TURNAROUND TIMES
Custom jewelry typically requires approximately 4–8 weeks, although some pieces may require additional time.
Turnaround time depends upon factors including design complexity, CAD development, client approval, metal availability, gemstone sourcing, casting, stone setting, horsehair preparation, hand finishing, outside specialty services, and current production volume.
Completion dates are estimates unless Elegant Elements By Kelly LLC expressly provides a guaranteed completion date in writing.
We are not responsible for reasonable delays caused by suppliers, carriers, severe weather, material shortages, client approval delays, events outside our reasonable control, or other circumstances that could not reasonably have been prevented.
12. SHIPPING HORSEHAIR & OTHER MATERIALS TO US
Clients are responsible for safely packaging and shipping horsehair, gemstones, jewelry, or other materials to Elegant Elements By Kelly LLC.
We strongly recommend using a shipping method that provides tracking.
Elegant Elements By Kelly LLC is not responsible for materials that are lost, stolen, delayed, damaged, or misdirected before confirmed delivery to us, except where responsibility cannot legally be excluded.
13. RETURN OF UNUSED HORSEHAIR
When sufficient horsehair remains after completion of a custom piece, we will generally return the unused hair to the client unless another arrangement has been made.
Because small amounts of hair may be trimmed, separated, tested, arranged, or otherwise used during the jewelry-making process, we cannot guarantee that every individual strand originally submitted will be returned.
14. SHIPPING COMPLETED JEWELRY
We take appropriate precautions when shipping completed jewelry.
Depending upon the value and destination of the order, shipments may include tracking, insurance, and/or signature confirmation.
Clients are responsible for providing a complete, accurate, and secure shipping address.
Elegant Elements By Kelly LLC is not responsible for delays caused by shipping carriers or circumstances beyond our reasonable control.
15. JEWELRY CARE & NORMAL WEAR
Fine jewelry is not indestructible.
Precious metals may scratch, chains may stretch or break, finishes may change over time, and gemstones or settings may require maintenance.
Horsehair jewelry should be treated with particular care.
Customers should avoid unnecessary exposure to chemicals, abrasive cleaners, excessive moisture where inappropriate for the piece, extreme temperatures, heavy impact, and activities that could damage the jewelry.
Normal wear and tear is not considered a manufacturing defect.
16. WARRANTY & REPAIRS
Any warranty offered by Elegant Elements By Kelly LLC is governed by the warranty terms in effect at the time of purchase.
Unless otherwise stated, warranties do not cover normal wear and tear, accidental damage, improper care, misuse, chemical exposure, loss, theft, damaged chains, lost stones caused by impact or wear, or alterations or repairs performed by another jeweler.
Jewelry may be submitted to Elegant Elements By Kelly LLC for repair evaluation. Repair charges may apply.
17. DIAMONDS & GEMSTONES
Diamonds and gemstones may vary naturally in color, clarity, cut, inclusions, patterns, and other characteristics.
Where applicable, clients may be offered natural diamonds, laboratory-grown diamonds, natural gemstones, synthetic stones, or other materials.
The specific characteristics of a custom piece will be established by the individual order, invoice, appraisal, proposal, or design agreement.
18. INTELLECTUAL PROPERTY & JEWELRY DESIGNS
All original website content, branding, photographs, videos, graphics, text, jewelry designs, design concepts, CAD designs, sketches, product descriptions, logos, and other creative materials belonging to Elegant Elements By Kelly LLC are protected by applicable intellectual-property laws.
Purchasing a piece of jewelry does not transfer ownership of the underlying design, CAD file, mold, photograph, creative concept, or other intellectual property.
Unless otherwise agreed in writing, Elegant Elements By Kelly LLC retains the right to reproduce or adapt its original jewelry designs.
No person or business may copy, reproduce, manufacture, commercially exploit, distribute, or use our protected content or designs without written authorization, subject to applicable law.
19. CLIENT-SUBMITTED CONTENT
Clients may voluntarily provide photographs, testimonials, reviews, stories, horse names, or other content.
We will use personally identifying client stories, photographs, testimonials, or similar promotional material in accordance with the permission provided by the client and applicable law.
Content submitted through a specific promotional, testimonial, or story-submission form may be governed by additional terms displayed with that form.
20. THIRD-PARTY LINKS & SERVICES
Our website may contain links to or integrations with third-party websites and services, including payment processors, installment-payment providers, appointment schedulers, forms, social-media platforms, shipping providers, and other services.
Elegant Elements By Kelly LLC does not control these independent third parties and is not responsible for their separate websites, practices, privacy policies, availability, or terms.
21. PROHIBITED USES
You may not use our website or its content to engage in unlawful activity, interfere with website security, transmit malicious code, attempt unauthorized access, collect information about others unlawfully, impersonate another person, commit fraud, infringe intellectual-property rights, or copy our content or designs for unauthorized commercial purposes.
We reserve the right to restrict access to our website or services where we reasonably believe these Terms have been violated.
22. RIGHT TO REFUSE OR CANCEL ORDERS
To the extent permitted by applicable law, Elegant Elements By Kelly LLC reserves the right to refuse or cancel an order because of suspected fraud, payment problems, material unavailability, obvious pricing or listing errors, inability to fulfill the requested design, misuse of our services, or other legitimate business reasons.
If we cancel a paid order that has not otherwise become non-refundable under these Terms, any refund legally or contractually due will be processed to the appropriate payment method.
23. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, our website and its content are provided on an “as available” basis.
Nothing in these Terms excludes any warranty, consumer protection, or other right that cannot lawfully be waived or limited.
24. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Elegant Elements By Kelly LLC and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of our website, products, or services.
Nothing in these Terms limits liability or consumer rights where such limitation is prohibited by law.
25. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Elegant Elements By Kelly LLC from third-party claims, damages, liabilities, and reasonable expenses arising from your unlawful use of our website, violation of these Terms, or infringement of another party's rights.
26. PRIVACY
Your use of our website is also subject to our Privacy Policy.
Please review our Privacy Policy to understand how personal information may be collected, used, stored, and shared.
27. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent legally permitted, and the remaining provisions will continue in effect.
28. NO WAIVER
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
29. GOVERNING LAW
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles, except where applicable consumer-protection laws provide otherwise.
30. CHANGES TO THESE TERMS
Elegant Elements By Kelly LLC reserves the right to revise these Terms periodically.
Changes will become effective when the revised Terms are posted on our website or on the effective date otherwise stated.
Customers are encouraged to review these Terms periodically.
